Merchant Terms of Service
By signing up for an Eden Couture Account (as defined in Section 1) or by using any Eden Couture Services (as defined below), you are agreeing to be bound by the following terms and conditions (the “Terms of Use”).
As used in these Terms of Use, “Eden Couture,” “we,” “us,” or “our” refers to the applicable Eden Couture entity as described in Section 13, and “you” refers to the user of our services—either an individual merchant or the business employing the user.
Eden Couture provides a platform that enables merchants (individual designers, boutiques, and fashion retailers) to create, manage, and operate digital storefronts through our hosted marketplace. Our platform supports the sale of ready-to-ship and made-to-order fashion items as well as the ability for customers to request and purchase custom-made designs.
These offerings, and any additional services we provide now or in the future, are collectively referred to as the “Service(s).”
New features or tools added to the current Services will also be subject to these Terms of Use.
You must read, agree to, and accept all the terms and conditions contained or expressly referenced in these Terms of Use, including our Acceptable Use Policy and Privacy Policy.
By using Eden Couture and the services we provide, you are agreeing to these terms. Be sure to occasionally check back for updates.
1. Account
1.1 - Creating Your Eden Couture Account
To start using Eden Couture, you'll need to create an account (“Account”). During sign-up, we'll ask for some basic info—like your full name, business address, phone number, email, and anything else we need to get you up and running. We reserve the right to decline or deactivate an account at our discretion, for any reason.
1.2 - Your Primary Email
The email you use when you sign up (or update later) will be our go-to way of contacting you (“Primary Email”). Make sure it works, and that you're checking it regularly. Any messages from this email will be considered as coming directly from you.
1.3 - Keeping Your Account Secure
You're in charge of keeping your account and password safe. If someone else gets into your account because your login info wasn't secure, we can't be held responsible for any issues that come up. We might ask for extra verification from time to time, and we can change our security requirements if needed.
1.4 - Support
We provide technical support only to registered Eden Couture merchants. If you have questions about these terms or how things work, our support team is happy to help.
1.5 - Fair Use of the Platform
Please don't copy, resell, or misuse any part of Eden Couture's platform or services without getting written permission from us first.
1.6 - Don't Try to Work Around the System
You agree not to:
- Try to get around any restrictions or limits we've built into the platform
- Process orders outside of Eden Couture's checkout system
- Use tools or code to unlock features that are intentionally disabled
- Reverse-engineer, decompile, or take apart any part of our services
1.7 - No Bots, ScrapeDesigner, or Spying Tools
You're not allowed to use any bots, spiders, scrapers, or other automated tools to access or monitor anything on Eden Couture.
1.8 - Your Content ("Materials")
Any content you upload or share with us—like product listings, images, videos, pricing, branding, or other media (“Materials”)—might be transferred across different networks and may be adjusted slightly to work with certain devices or systems.
2. Eden Couture Rights
2.1 - We Don't Pre-Approve Everything
We don't review products or verbage before it goes live, but we do reserve the right to remove anything that goes against our policies or isn't a good fit for Eden Couture. That includes content or listings that we believe break the rules, or if something just isn't appropriate for the platform. Basically: don't post anything shady, harmful, or dishonest.
2.2 - Be Kind
We take community behavior seriously. Bullying, threats, or abusive behavior—whether it's toward another merchant, a shopper, or someone on our team—won't be tolerated. That kind of behavior could lead to account suspension or permanent removal from the platform.
2.3 - No Exclusivity Promises
Eden Couture is an open marketplace, so we may provide services to multiple merchants who offer similar (or even nearly identical) items. We don't play favorites, and we don't guarantee exclusivity to anyone.
3. Your Responsibilities
Running a shop on Eden Couture means you're in charge of what you sell and how you handle your customers. We're here to provide the tools - you handle the rest.
3.1 - You're Responsible for Your Store
Everything you sell on Eden Couture—products, descriptions, pricing, refunds, taxes, delivery timelines, and how you communicate with customers—is your responsibility. That includes making sure everything is accurate, honest, and follows any legal requirements that apply to your location or your customer's.
3.2 - Be Transparent with Customers
You agree to accurately enter your shop's contact information, your return/refund policy, and how long it typically takes you to ship or fulfill orders.
3.3 - Play by the Rules
Don't use Eden Couture for anything illegal or shady. That includes violating copyright laws, selling restricted items, or breaking laws that apply in your region or your customer's region. You're also responsible for any licenses, permits, or other legal hoops your business might need to jump through.
3.4 - Checkout Must Go Through Eden
All sales from your shop must go through Eden Checkout, our checkout system powered by Shopify's checkout process. That's the secure flow where customers add items to their cart, enter their shipping and payment info, and complete their order. You agree not to bypass Eden Checkout for any purchases made through your Eden Couture storefront.
4. Limitation of Liability
4.1 - You're Responsible for What You Do
If you break the law, violate someone else's rights, or go against these Terms, and someone files a claim or lawsuit, you're the one responsible—not Eden Couture. That includes any legal fees or costs that come up because of it.
4.2 - We're Not Liable for Certain Things
We provide Eden Couture “as is” and “as available.” That means we don't guarantee it will always be perfect, uninterrupted, or bug-free. We're not responsible for any losses you might experience while using the platform—like lost profits, lost data, or business disruptions—even if we could've seen it coming.
4.3 - No Promises About Results
We can't promise that using Eden Couture will get you more sales, better customers, or instant success. We also don't guarantee that every feature will work exactly the way you want it to at all times.
4.4 - Taxes are your responsibility
You're in charge of your own taxes. We don't handle or calculate taxes for your store or report anything to your local tax authorities.
4.5 - Third-Party Claims
If someone sues Eden Couture because of something you did—whether it's due to your products, refund policies, customer interactions, or anything else related to your store—you agree to cover any damages, costs, and legal fees that result from it.
4.6 - You're Also Responsible for Your Team
If your team members, subcontractors, or business partners break the rules, it's treated the same as if you did. Make sure anyone who works with you understands the Terms and follows them too.
5. Intellectual Property & Your Content
We know your designs, photos, and words are your creative work. You still own what you upload to Eden Couture—but by using our platform, you're giving us permission to use that content to run and promote the Services.
6. Social Media & Promotional Content
We love showing off the amazing things that shops on the Eden platform make, and social media is one of the ways we do that.
6.1 - You Let Us Share Your Work (To Promote You!)
By uploading content to your shop or tagging Eden Couture on social media, you're giving us permission to feature that content on our own channels—like our website, Instagram, newsletters, or marketing campaigns. This includes things like product photos, videos, customer reviews, and behind-the-scenes content you've posted or uploaded.
6.2 - What We'll Use It For
We may use your content to (but not limited to):
- Highlight your shop or product on social media
- Include your listing in promotional materials (like gift guides or trend roundups)
- Share content in email features or community spotlights
- Repost your tagged content with credit
- We'll alays do our best to tag or credit you when we post your work.
6.3 - You Still Own Your Content
This doesn't mean we own your content—you still do! You're just giving us permission to use it in ways that promote your shop and the Eden Couture platform.
6.4 - Want to Opt Out? No Problem.
If you'd prefer we don't use your content for promotional purposes, just email us at
[email protected] or send us a message via our instagram at @edencouture.co with your shop name and a quick note saying you'd like to opt out. We'll respect your choice and make sure your content isn't used going forward.
7. Customer Communications
We want customers to have a great experience—and that means respecting their inboxes and privacy.
7.1 - Only Contact Customers Who Opted In
You agree that you'll only send marketing emails, texts, or messages to customers who have explicitly opted in to receive those communications from you. For example, customers must check a box or otherwise agree during checkout before you can add them to your marketing lists.
7.2 - Follow the Rules of Email & Messaging Services
If you use email marketing tools, SMS platforms, or any other messaging services to contact your customers, you promise to follow the acceptable use policies and anti-spam rules of those services. This includes things like providing easy unsubscribe options and not sending unwanted or misleading messages.
7.3 - Keep Customer Info Private and Secure
You're responsible for managing any customer contact info you collect in a secure and respectful way, in line with applicable privacy laws and regulations.
8. Eden Couture Shop
Eden Couture shop is a sales channel available only to certain qualified shops (“Eligible Merchants”). It lets customers browse and shop your products right within the Eden Shop App.
8.1 - What's the Eden Couture Shop?
The Eden Couture Shop is part of our platform that helps customers discover and shop from our community of merchants. It shows product listings, your shop branding, and other info from your Eden Couture Store. Customers can browse and buy directly in the app, but all orders are processed through your own store.
8.2 - Who Can Use It?
Only shops that meet our eligibility rules and follow the Eden Shop Merchant Guidelines can use the Shop App. We reserve the right to approve or remove any merchant's access to the app at any time, without warning.
8.3 - Your Content on the Eden Couture Shop
We may display your products, branding, and other content from your store in the Eden Shop App to help promote your shop and sales. Your responsibility for your content and sales stays the same as on your store, including compliance with our Terms and any legal requirements.
8.4 - How Content is Shown
Content in the Eden Shop App is ranked and displayed based on things like relevance to searches, image quality, shop reputation, and customer engagement.
8.5 - Managing Your Materials on the Eden Couture Shop
If you don't want your products or content to appear in the Eden Couture Shop, it's up to you to manage or deactivate this feature in your store settings. If you need help with this or don't have the Shop App channel installed yet, you can find setup or removal instructions [link placeholder] or contact our support team.
8.6 - Orders and Customer Service
Even if customers shop through the Eden Couture Shop, all orders and customer service happen through your Eden Couture Store. We're not responsible for any disputes or issues between you and your customers.
8.7 Removing Your Store
If you delete your Eden Couture Account, your products and content will be removed from the Eden Couture Shop.
9. DMCA and Copyright
We respect copyright and expect you to too.
If someone says your content breaks copyright rules, we might remove it to be safe and let you know about the issue.
If you think your content was taken down by mistake, you can tell us and we'll check it out.
The person who complained has two weeks to take legal action; if they don't, we'll put your content back.
If you think someone else is using your work without permission, you can send us a notice to let us know.
10. Privacy and Data Protection
We take privacy seriously - yours and your customers'.
By using Eden Couture, you agree that we collect and use personal information as explained in our Privacy Policy. This covers how we handle your info and your customers' info.
We're committed to protecting personal data and following the laws that apply to data privacy.
11. Modifications
11.1 - Updating Policies
We can update or change these Terms anytime. If the change affects your rights or how you use Eden Couture in a substantial way, we'll let you know ahead of time, usually via email or within the platform.
11.2 - Important Changes
We may need to make important changes right away without advance notice — for legal reasons, to stop abuse, or to keep things safe and fair.
11.3 - Updated Policy
When we post updated Terms here, those changes take effect right away (unless we say otherwise). If you keep using Eden Couture after the update, it means you agree to the new Terms.
11.4 - Agreeing to Changes
If you don't agree with any changes to our terms, you'll need to stop using the Services.
11.5 - Notice
We might also change our fees from time to time. If we do, we'll give you at least 30 days' notice by email or your account.
11.6 - Responsibility
We're not responsible for any issues if we change, pause, or stop parts of the Service.
12. General Terms
12.1 - Full Agreement
These Terms (including any documents they refer to) are the full agreement between you and Eden Couture about using the Services and your Account. They replace any earlier agreements.
12.2 - No Waiver
If Eden Couture doesn't enforce a right or rule right away, it doesn't mean we're giving up that right.
12.3 - Severability
If a court finds any part of these Terms invalid or illegal, we'll adjust that part to the extent possible without affecting the rest of the Terms.
12.4 - No Third-Party Rights
Only you and Eden Couture have rights or responsibilities under these Terms — no one else can enforce them unless we say so.
12.5 - Governing Law
These Terms are governed by the laws of the United States.
12.6 - Language
If these Terms are available in other languages, the English version will always be the official one if there's any conflict.
12.7 - Assignability
These Terms apply to both you and Eden Couture, and anyone who takes over your or our rights (like heirs or successors).
12.8 - Enforceability
If any part of these Terms is found to be invalid or unenforceable, the rest still applies.
12.9 - Survival After Termination
If your Account or Services end, most obligations end too — but you still have to handle any orders or responsibilities from before termination. Some sections, like fees, liability, and privacy, will still apply even after your Account is closed.
